Terms of Service

1. Service Overview
Cohorty (hereinafter referred to as "the Service") is a platform where users set goals, track progress, and engage with the community to achieve them. By accessing or using the Service, you agree to be bound by these Terms of Service.
2. Account Registration
To use the Service, you must create an account and agree to the following:
- Provide accurate, complete, and up-to-date information.
- Be responsible for maintaining the confidentiality of your account credentials.
- Immediately notify us of any unauthorized use of your account.
- Be at least 13 years old. Users under 18 require parental or guardian consent.
3. Prohibited Activities
You agree not to engage in any of the following activities:
Illegal or Harmful Activities
- Violating laws or regulations.
- Infringing intellectual property rights.
- Engaging in fraud, harassment, or abusive behavior.
- Distributing spam, malicious code, or false information.
Technical Misuse
- Unauthorized access to systems or networks.
- Use of bots, automation, or scraping tools.
- Reverse engineering or attempting to extract source code.
Other Prohibited Conduct
- Using another person's account without permission.
- Using the Service for commercial purposes without authorization.
- Interfering with or disrupting the operation of the Service.
4. Guest Accounts
Guest accounts provide limited, temporary access to the Service:
- Guest accounts are limited to 3 active challenges
- No email or personal information is required initially
- Guest account data will be deleted after 30 days of inactivity
- Convert to a full account to retain your data permanently and access all features
- Guest accounts cannot access premium features or data export functionality
5. Data Ownership & Privacy
Your Data Rights
- You retain all rights to your data. All content, progress records, and personal information you create belongs to you.
- We never sell your personal information. Your data is used only to provide and improve the Service.
- You can export your data at any time from Profile Settings → Download My Data (CSV).
- You can delete your account and data at any time from Profile Settings → Delete Account.
Data Retention
- Active account data is stored indefinitely while you use the Service
- Deleted account data is permanently removed within 30 days
- Public challenges you created remain visible to other participants even after account deletion, but your username will show as "[Deleted User]"
- To completely remove a challenge before deleting your account, delete the challenge first, then delete your account
6. Content Ownership and Use
- Users retain ownership of the content they create and post on the Service.
- By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content as necessary for operating the Service.
- We reserve the right to remove or restrict access to content that violates these Terms or is deemed inappropriate.
- You are solely responsible for the content you submit and its consequences.
- Record Modification: You may edit or delete your challenge records within 48 hours of creation through the Dashboard. After this period, records become permanent for data integrity and community transparency.
7. Premium and Pro Subscriptions
Cohorty offers Premium and Pro subscription plans with enhanced features. The following terms apply to all paid subscriptions:
Available Plans
- Premium Plan: $5.99/month or $49.99/year (30% OFF). Includes 7 active challenges, advanced analytics, habit formation tracking, and more.
- Pro Plan: $9.99/month or $89.99/year (25% OFF). Includes all Premium features plus unlimited challenges, Team Management, CSV Export, and Team Insights.
- Free Plan: Available to all users with 3 active challenges and basic features.
Subscription Terms
- Contract Period: 1 month (monthly plan) or 1 year (yearly plan) from registration date
- Automatic Renewal: Premium and Pro subscriptions automatically renew monthly or annually unless canceled
- Billing: Initial charge occurs at subscription registration. Subsequent charges occur automatically on each renewal date
- Cancellation: You can cancel your subscription anytime from Profile Settings. After cancellation, you will not be charged on the next renewal date
- Refunds: For refund requests, please contact info@cohorty.app. We offer prorated refunds based on the usage period
- Price Changes: We will announce price changes at least 30 days in advance
Plan Changes
- Upgrading: Changes from Free to Premium, Free to Pro, or Premium to Pro are applied immediately. You'll be charged the prorated difference for the remaining billing period.
- Downgrading: Changes from Pro to Premium, Pro to Free, or Premium to Free take effect at the end of your current billing period. You'll retain access to premium features until the period ends.
- Switching Billing Cycles: You can switch between monthly and yearly billing at any time. Switching to yearly charges immediately; switching to monthly takes effect at the end of your current period.
- After Cancellation: Premium/Pro features remain active until the end of your current billing period
- All data created during Premium/Pro period remains accessible after downgrade or cancellation
- Your account automatically reverts to the Free plan after cancellation
8. Service Availability & Modifications
- Service Availability: We strive for 99.9% uptime but do not guarantee uninterrupted access
- Scheduled Maintenance: We will announce planned maintenance in advance when possible
- Feature Changes: We may modify, add, or remove features to improve the Service
- Terms Updates: We may update these Terms with 30 days notice for material changes
Account Termination
- We may suspend or terminate accounts that violate these Terms
- You may terminate your account anytime from Profile Settings
- Upon termination, your access ends immediately but data deletion follows our Privacy Policy
9. Disclaimers & Limitations
Service Disclaimer
- The Service is provided "as is" and "as available" without warranties
- Cohorty is NOT medical, health, or professional advice
- Consult qualified professionals for health-related goals
- We do not guarantee accuracy, reliability, or availability
Limitation of Liability
- We are not liable for indirect, incidental, or consequential damages
- Total liability is limited to amounts paid in the past 12 months
- We are not responsible for user-generated content
- Use the Service at your own risk
10. Governing Law and Jurisdiction
These Terms of Service are governed by and construed under the laws of Japan. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court.
